Activity: creation and sale of textile artworks and artistic creations

Purpose

These Terms and Conditions of Sale govern all sales made through the website www.lecernenoir.fr⁠
The website offers original textile artworks designed and created by Elodie LAVADOUX under the name “Le Cerne Noir”, as well as, secondarily, handcrafted creations derived from her artistic universe.
Each artwork is a unique piece, conceived as a work of art in its own right.

Intellectual Property

All elements of the website www.lecernenoir.fr⁠, including artworks, images, visuals, texts and content, are protected by intellectual property laws.
The artworks offered for sale are original, unique and signed creations by Elodie LAVADOUX.
Any reproduction, representation, modification, publication, adaptation or use, in whole or in part, of the website content or artworks, by any means whatsoever, is strictly prohibited without prior written authorization.
The purchase of an artwork does not transfer any reproduction or exploitation rights. The buyer is granted a private use only. Any commercial use or public display is prohibited without prior consent.
Any unauthorized use may result in legal action in accordance with applicable intellectual property laws.

Personal Data

The information collected on the website www.lecernenoir.fr⁠� is necessary for order processing and customer relationship management.
This data may include: name, surname, address, email address and delivery information.
It is used solely within the scope of Le Cerne Noir’s activity and is never shared with third parties, except where required by law or necessary for the execution of the service (carrier, payment provider).
Data is retained only for the period strictly necessary for processing purposes.
In accordance with the General Data Protection Regulation (GDPR), individuals have the right to access, rectify, object to and delete their personal data.

Acceptance of the Terms and Conditions

Any order placed and validated online implies full acceptance of these Terms and Conditions of Sale.
Elodie LAVADOUX undertakes to comply with the obligations set out in these Terms and Conditions.
These terms may be modified at any time. The applicable terms are those in force at the time of the order placed on the website.

Ordering Process

Nature of artworks and creations
The website offers original textile artworks as well as, secondarily, handcrafted creations.
The artworks are unique, handmade pieces. They may include variations, irregularities or specific characteristics inherent to the creative process and cannot be considered defects.
The photographs and visuals presented on the website aim to represent the artworks and products as accurately as possible. However, slight differences may occur due to screen settings or shooting conditions.
Such differences shall not engage the liability of Le Cerne Noir.
During the ordering process, users may select one or more products and add them to their cart. After reviewing their order, they may proceed to validation (order validation implies acceptance of the Terms and Conditions).
The user will then access a secure form to provide the necessary personal data to complete the order.
The order is considered effective upon receipt of payment.
The website publisher will acknowledge receipt of the order by email within 48 hours.
Elodie LAVADOUX reserves the right to refuse an order in the event of a prior dispute with the same customer.

Prices

Prices are expressed in euros (€), all taxes included (VAT not applicable pursuant to Article 293B of the French General Tax Code), excluding shipping costs.
Shipping costs are indicated before order validation.
For orders shipped outside the European Union, customs duties and local taxes may apply. These charges are the sole responsibility of the buyer. Le Cerne Noir cannot be held responsible for these costs or their application.
Prices may be modified at any time. However, the price applied is the one in force at the time of order validation.

Payment

Payments are processed via the secure platform Stripe.
An order is considered validated only after payment confirmation.
In the event of refusal by the banking institution, the order will be automatically canceled.
Transactions are secure, and banking information is never transmitted to the Le Cerne Noir website.

Shipping and Delivery

Orders are shipped within a maximum of 5 business days from receipt of payment for items in stock.
For artworks requiring production, the creation time is 3 to 4 weeks, subject to material availability.
Shipping is carried out via La Poste, Colissimo, Chronopost, or any other carrier selected through a shipping platform.
Delivery is available in France and internationally.
Shipping costs are calculated based on weight, volume, and destination, and are indicated before order validation. Shipping is free for orders over €300 (excluding shipping costs).
Any customs duties and import taxes are the responsibility of the buyer.
The seller shall not be held liable for delays, loss or damage attributable to the carrier once the parcel has been shipped.
It is the customer’s responsibility to check the condition of the parcel upon receipt and to make any necessary reservations with the carrier.

Right of Withdrawal

In accordance with applicable law, the customer has a period of 14 days from receipt of the order to exercise their right of withdrawal.
To exercise this right, the customer must notify their decision by email.
Products must be returned in their original condition, complete and in perfect resale condition. Return shipping costs are the responsibility of the customer.
Refunds will be issued after receipt and inspection of the returned product.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized or made-to-order artworks.

Returns

After-sales service is provided by Le Cerne Noir.
Returns are only accepted in the case of proven manufacturing defects.
Any return request must include supporting photographs and a description of the defect.
After validation, an exchange or refund may be offered.
No return will be accepted without prior agreement.

Out-of-Stock Items

Unless otherwise stated, the artworks offered are unique pieces.
In case of unavailability, Le Cerne Noir does not guarantee the reproduction of an identical artwork.
Some handcrafted creations may be reproduced or adapted, subject to material availability.

Liability

Le Cerne Noir shall not be held liable for any damage resulting from improper use of the products.
Variations in color or appearance due to materials used or environmental conditions (light, maintenance, surroundings) cannot be considered defects.
Le Cerne Noir declines all responsibility in the event of allergic reactions to materials used.
The creations are not intended for children. Parents are responsible for ensuring appropriate use.
Any improper use of the artworks (exposure to heat sources, risk of suffocation, etc.) is the responsibility of the user.
